Hi, my friend at work had her purse stolen in a Pizza place’s parking lot after she exited the pizza place. She just purchased the pizza and walked out the door and was about to get into her car. She put the pizza on the roof of her car and 2 guys came up and ripped the purse off of her shoulder. It is a bad neighborhood. Can she sue the pizza place (because the parking lot is their property) for being negligent in not providing security?
The store’s duty of care did not extend to safeguard against the criminal activity of a third party, by providing its own security for the parking lot. This falls within a well established principle of negligence. As well, it is just one of the many hurdles your friend faces. So no case.

No. They sell pizza, not protection. Anyone living and doing business in a bad neighborhood should watch for thieves and have their keys in their hands to get in the car fast. Sorry for your friend.

In this country, anybody can sue anybody for any reason. So, the question is not "CansheI sue?" but, the question should be " Is this a lawsuit that she can win?? I doubt it. Turn the situation around. What if, instead of a pizza place, the robbery had happened in your driveway? Are you obligated to provide security for anyone parking in your driveway, and are you negligent if someone gets robbed in your driveway because you did not provide security?

And what was your friend doing being so careless in a neighborhood she knows to be a bad neighborhood. ? Why was she even stopping there? Has she (and you) ever heard of using common sense? Of being careful? Of exercising due diligence?

Yes. She can sue. Will she win? No! It would appear that since you knew it was a bad neighborhood, so should see. So, she took the chance to go to the bad area knowing what may happen. Secondly, no one can predict what is going to happen. Does that mean if you are waiting at a cross walk and get mugged you can sue the city? You are waiting at a bus stop and get mugged you can sue the bus company?
She is taking things to far!
